Duties of Bail Bond Agent

A person who has been held in a jail for committing a crime may be released upon hearing of his/her case in a court of law or being released on a bail. The bail also referred to as bail bond will promise to confirm that the criminal defendant will appear in a court of law for the hearing of the case of the scheduled date and time. The amount of the bail bond is usually set by the court. The bail bond helps prevent the defendant from abusing the appeal process. Appealing for reasons nor intended is usually the major reason for giving a bail bond to avoid its abuse. Most of the appeals are done once the defendant feels that the ruling given by the court is not fair hence would wish the decision to be reviewed.

When a person is being given a bail bond, there are various factors that are considered to determine its value. The major consideration made is the nature and severity of the committed crime with the more severe ones attracting a higher value of the bail bond. In situations where the threat level posed by the criminal to themselves or the society around them is high, a higher value of the bail bond will be attracted as compared to low threat level. A person whose previous records indicate more crimes committed will attract higher bail bond than a person who has previous criminal encounters. There are times when the criminal may be denied a bail bond and will have to remain there until the case is heard and determined.

A bail bond agent will post a bond on behalf of the surety bond company where they charge a given percentage of the total bail bond as service charge. Collaterals in form of securities, a valuable property or even the defendant’s credit worthiness can be given to the bail bond agent so that he can post a bail bond for the defendant The collateral is given as an insurance between the defendant and the surety bond company. The bail bond posted by the bail bondsman is paid to the court in a situation where the defendant doesn’t appear in court and the bail bondman remains with the collateral. The defendant will be given back the collateral less the service fee charged if he/she appear in court at the scheduled date and time and the case is concluded. Knowledgeable and skilled bail bond agents are the best people to help one when unable to post a bail bond by themselves to get out of jail.
